Terms of service

1. Who we are
Wheels & Bids (the “Service”, “we”, “us”) is a software product operated by Blu Mint Digital (blumint.com.au), an Australian digital services business. Wheels & Bids is not a separate company. These terms are an agreement between you and Blu Mint Digital. By creating an account, publishing a listing, placing a bid, or otherwise using the Service, you agree to these terms.
2. What the Service is — and what it is not
The Service provides sellers with a hosted, shareable auction page for their vehicle, together with supporting software: a bidding engine, countdown timer, anti-snipe extensions, watcher notifications, a public Q&A thread, and related tooling.
We are a software provider only. We are not:
- a party to any sale contract between a seller and a buyer;
- an auctioneer, motor dealer, broker, or agent of any seller or buyer;
- a payment processor, escrow agent, or holder of sale proceeds;
- an inspector, valuer, or certifier of any vehicle.
The sale itself — payment, paperwork, transfer of registration, and handover — happens directly between the seller and the winning bidder, off the platform. We do not take commission on sales and we never hold the sale money.
3. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate account information and keep your sign-in method secure. You are responsible for activity on your account.
- One person, one account. Accounts that evade bans, impersonate others, or manipulate auctions may be suspended or permanently banned, including any associated accounts.
4. Sellers and listings
- You may only list a vehicle you legally own or are authorised to sell, and the listing must be accurate and complete to the best of your knowledge. You must disclose known defects, damage history, finance owing, and anything a reasonable buyer would want to know.
- You must hold the rights to all photos, videos, and text you upload, and you grant us a non-exclusive, royalty-free licence to host, display, and promote that content as part of operating the Service (including share previews and an archived results page).
- Vehicle data shown on a listing (including data pre-filled from registration or VIN lookups and PPSR-derived indicators) is provided for convenience from third-party sources. It may be incomplete, out of date, or wrong, and it is the seller's responsibility to verify it before publishing.
- We may decline, edit metadata of, unpublish, or remove any listing that we reasonably believe is inaccurate, unlawful, fraudulent, or harmful to the integrity of the Service.
5. Fees
- Publishing a listing costs a flat fee (currently AUD $49, displayed at checkout and inclusive of GST where applicable), payable before the auction goes live. We charge no commission on the sale.
- The listing fee pays for the build and hosting of your auction page and is non-refundable once the auction has gone live, except where required by law or expressly stated otherwise (for example, a relist credit).
- If a winning bidder fails to complete the purchase, we may at our discretion issue a free relist credit for the same vehicle. Relist credits expire 180 days after issue.
6. Bidding and buyers
- Every bid is a binding offer to buy the vehicle at the bid amount. Do not bid unless you intend and are able to complete the purchase.
- Bids must meet the displayed minimum increment. Bids placed in the final minutes may extend the auction (anti-snipe). Bids cannot be retracted.
- Buying a used vehicle carries risk. You are responsible for your own due diligence — inspections, PPSR checks, finance checks, and test drives — before the auction ends. We make no representation about the condition, title, or merchantability of any vehicle.
- When an auction ends with a winning bid, we share the seller's and winning bidder's contact details with each other so they can settle the sale. Failing to honour a winning bid, or a sale as a seller, may result in a permanent ban.
7. Acceptable use and content
- You must not use the Service to do anything unlawful, including shill bidding, bidding on your own listing through another account, odometer fraud, title washing, or misleading or deceptive conduct.
- Q&A comments and seller updates are public. We may moderate, soft-delete, or remove content that is abusive, off-topic, deceptive, or unlawful, and may ban authors of such content.
- You must not scrape, reverse engineer, overload, or interfere with the Service, or attempt to access data that is not yours.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Blu Mint Digital or its licensors. Apart from your own listing content, you may not copy, modify, or redistribute any part of the Service without our written permission.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not guarantee that your vehicle will sell, that any price will be achieved, that bidders or sellers will perform, that third-party data (including PPSR-derived indicators) is accurate, or that the Service will be uninterrupted or error-free.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other legislation that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
10. Liability and indemnity
- Subject to clause 9, our total aggregate liability to you arising out of or in connection with the Service is limited to the listing fees you paid to us in the 12 months before the event giving rise to the claim.
- Subject to clause 9, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or for any dispute, loss, or damage arising from a sale (or failed sale) between a seller and a buyer, from the condition or title of any vehicle, or from content submitted by users.
- You indemnify Blu Mint Digital against claims, losses, and expenses (including reasonable legal costs) arising from your breach of these terms, your listing or other content, or your conduct in a sale, except to the extent we caused the loss.
11. Suspension and termination
We may suspend or terminate your access (including cancelling listings and bans that persist across new accounts) if you breach these terms, if we reasonably suspect fraud or manipulation, or if required by law. You may close your account at any time; clauses that by their nature survive (including clauses 8–10) continue after termination.
12. Privacy
Our collection and handling of personal information is described in our Privacy Policy, which forms part of these terms.
13. Changes to the Service or these terms
We may update the Service and these terms from time to time. Material changes will be posted on this page with a new effective date, and continued use of the Service after the change takes effect constitutes acceptance. The terms in force when an auction goes live govern that auction.
14. Governing law
These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
